The claimant is permitted to withdraw the amount deposited by the appellant on furnishing solvent surety / security to the satisfaction of the Registrar (Judicial) of this Court. The claimant shall also file an undertaking stating that if at the time of hearing it is found that the claimant is not entitled for the amount withdrawn by him he will re-deposit the amount with interest as may be determined by this Court, within two months.

The amount be given only after solvent surety/ security and undertaking are filed.

The civil application is allowed in the above terms.
