We have looked into papers with assistance of learned Assistant Government Pleader as nobody appears for respondent no.3.

In prayer clause, prayer is to strike down provisions of Clause-39 (2) of Bye-laws of the Taluka Sahakari Dekhrekh Sanstha Limited, Daryapur. Learned Assistant Government Pleader has invited our attention to pleadings particularly in paragraph no.5 of writ petition to show that there challenge appears to be to Clause-39 (A) of Bye-laws. She has also pointed out that Taluka Sahakari Dekhrekh Sanstha Limited, Daryapur is not party respondent in the matter.

This Court has not granted any interim order. Clause-39 deals with composition of Managing Committee.

We therefore find that challenge is rendered infructuous. Writ petition is dismissed. Rule stands discharged. No costs.
