This application seeks transfer of H.M.P.No.71 of 2014 which is pending before Civil Judge, Senior Division, Buldhana on the ground that the applicant who is respondent in the petition, stays at Akola and would find it difficult to attend the case at Buldhana. 3.

The parties to this petition are litigating since last 3-4 years. The applicant/wife has already moved application seeking maintenance and certain orders are passed in her favour. She stated that it would be very inconvenient for her to travel to Buldhana for attending this case.

The learned counsel for the respondent opposed this application on the ground that the applicant has secured order of maintenance and if such maintenance is paid, it would not be difficult for the applicant to attend the case at Buldana.

I am not convinced with this defence.

Apparently the maintenance would not be sufficient for

MCA810-14.odt travelling from Akola to Buldhana. The application deserves to be and same is allowed in terms of prayer clause (A).
