Heard learned counsel for the rival parties.

Para 9 of the reply reads thus:- "9.

This non-applicant humbly submits that, the accused/non-applicant has been identified in the present crime by the complainant and her other family members.

The applicant is a history-sheeter and is habitual offender involved in the similar offences which has been committed in the State of Madhya Pradesh. There are several cases registered against the applicant, in respect of similar offences, in the State of Madhya Pradesh. It is submitted that, the applicant is the resident of Chinni, Tahsil Paraswada, Distt. Balaghat, Madhya Pradesh and there is likelihood that he may not face trial and may abscond if he is released on bail. It is submitted that, out of six accused persons only three have been arrested. Two are notorious international criminals and are still absconding. It is submitted that, there is

every possibility that if the present applicant is released on bail his presence may not be secured and he may not face trial for the offence registered against him.

The application under reply is liable to be rejected and it may kindly so be rejected."

In view of the above and the earlier application made by the applicant for bail having been withdrawn, Criminal Application No. 357 of 2015 is rejected. Trial is expedited.
