DATE : 26/07/2018 There is an appeal under Rule 2 (2) of the Maharashtra Prisons (Mumbai Furlough and Parole) (Amendment) Rules, 2018 published on 16/4/2018 before the Additional Director General of Prisons and Inspector General of Prison and Correctional Services.

We think that in the present case, the remedy of appeal has to be exhausted first. The period spent by the petitioner in prosecuting the present writ petition shall be ignored while counting the period of limitation. The questions are left open to be adjudicated and decided in appeal.

With these observations, the criminal writ petition is dismissed.
