Hearing was conducted through video conferencing and the learned counsel agreed that the audio and visual quality was proper.

Heard learned counsel Shri D.A.Sonwane for the applicant and learned Additional Public Prosecutor Shri A.R.Chutke for the State.

The applicant is arrested on 1.3.2020 in connection with Crime No.35/2020 registered with Darwha Police Station, Yavatmal for offences punishable under Sections 461 and 380 of the Indian Penal Code. The First Information Report was lodged in respect of theft regarding Soyabean. The name of the applicant was not there in the First Information Report. However, when the applicant was arrested in Crime No.671/2019, during investigation in the .....2/-
said crime, role of the present applicant is found in the present crime.

Offence punishable under Section 461 of the Indian Penal Code is bailable one and offence under Section 380 of the Indian Penal Code is punishable only for 7 years. 5.
Since the First Information Report was lodged against unknown persons and looking to quantum of punishment, I pass following order:
ORDER
(1) The criminal application is allowed.
(2) Applicant-Sayyed Shahadat/Ayyad Muzafar, in connection with Crime No.35/2020 registered with Darwha Police Station, Yavatmal for offences punishable under Sections 461 and 380 of the Indian Penal Code, be released on bail on his executing a P.R.Bond in the sum of Rs.10,000/- with one solvent surety of the like amount.
(3) The applicant shall attend the police station once in a month i.e. on last Tuesday of every month, till trial is concluded.
(4) With this, the criminal application stands disposed of accordingly.
(5) The order be communicated to the counsel appearing for the parties, either on the e-mail address or on WhatsApp or .....3/-
by such other mode, as is permissible in law. JUDGE !! BRW !!
