Shri Bhandarkar, the learned counsel for the petitioners, states that the petitioners are desirous of availing an appropriate remedy and, hence, they may be permitted to withdraw the writ petition. The learned counsel states that the petitioners have paid a substantial sum to the respondent no.1-Trust towards the regularization of the plots. It is stated that the Nagpur Improvement Trust should refund the amount to the petitioner. The request made on behalf of petitioners for refund of the amount is accepted by the learned counsel for the Nagpur Improvement Trust. It is stated that the said amount would be refunded to the petitioners within a period of eight weeks. We accept the statement made by the learned counsel for the respondent no.1-Nagpur Improvement Trust, which would be binding on the trust.
On the motion made by the learned counsel for the petitioners, we permit the petitioners to withdraw the petition. The points raised in the petition are kept open. JUDGE JUDGE APTE
