Learned Advocate for respondent No.1 submits that the appeal filed against the impugned judgment and order by Vidarbha Irrigation Development Corporation-respondent No.2 herein namely First Appeal No.1001/2013 (Vidarbha Irrigation Development Corporation, through its Executive Engineer Vs. Hiralal s/o Gulabdeo Bhaiswar and ors.) with Cross Objection No.23 of 2021 in First Appeal No.1001 of 2013 (Hiralal s/o Gulabrao Bhaiswar and ors. Vs. Vidarbha Irrigation Development Corporation, through its Executive Engineer and ors. ) has been dismissed.

3. Learned Advocates for the parties therefore, submits that this appeal is covered by the decision in First Appeal

It is seen that appeal filed against the same judgment and award has been dismissed by the Coordinate Bench of this Court. In view of this, nothing survives in this appeal. This appeal is accordingly, dismissed.
