Chahande, learned counsel for the respondent Nos.1 to 4 who are the original plaintiffs states on instructions that on the next date of the proceedings before the trial Court the plaintiffs would submit a pursis closing their side of evidence. In view of this statement the apprehension expressed on behalf of the petitioner does not survive. After the plaintiffs close their evidence, the defendant No.1 is free to examine her witness. The impugned order therefore does not survive. Same is accordingly set aside.

The writ petition is disposed of. No costs.
