The learned counsel for the petitioner submits, on instructions received, that the petitioner shall be satisfied if the trial is expedited, in which event, the challenge to the order impugned which is an interim order, shall not be pressed. It is further submitted that the interim order shall be scrupulously complied with.

The petition is disposed of as withdrawn.

Considering the nature of the proceeding, and the fact that the applicant - wife has already filed on record her affidavit in lieu of oral examination-in-chief, the trial is expedited. The learned Magistrate is requested to conclude the trial as expeditiously as possible, and in any event within the next nine months.

It is made clear that before commencing with the

wp500.21.O.odt trial the learned Magistrate shall be satisfied that every rupee payable by the husband in view of the interim order, is duly paid to the wife and the child.
