Learned counsel for the applicant states that after recording the evidence of first witness, as the trial did not conclude within sixty days, a ground for seeking bail has become available to him under Section 437(6) of Code of Criminal Procedure.

Accordingly, he prays for withdrawal of the present application with liberty to apply before the trial Court for grant of bail on the ground mentioned herein above.
