Heard Mr Vyas, learned counsel for petitioner and Mr A. S. Fulzele, learned Assistant Government Pleader for respondents.

Prayer is to direct respondents to either decide application moved by petitioner for opening new Urdu medium primary school at village Chincholi, Tahsil Shegaon, District Buldana or to communicate decision thereon, if taken. Application is moved on 20.5.2008 as per petitioner.

Petitioner does not mention any representation moved thereafter pointing out pendency of such application and seeking its expeditious consideration. Petitioner has pointed out information dated 26.2.2010 sent by Information Officer And Administrative Officer of Directorate of Priary Education to one Dr Iqbal Khan, but that information is also of the year 2010. In thissituation,

we find approach belated.

If the need still exists, petitioner can even today move fresh application in accordance with law. 5.

As such, we do not find any prejudice caused to the petitioner because of long pendency of its application. Petition is accordingly disposed of. No costs.
