Issue notice to the non-applicant/State.
The learned A.P.P. waives notice on behalf of the State and files on record reply of the prosecution. Perused the F.I.R. and the reply of the prosecution. It is seen that although it is the version of the complainant, who is the wife of this applicant, that the pill in question, which was meant for medical termination of the pregnancy, was given to her by this applicant without apprising her of the purpose for which it was given, the fact remains that this application seeking grant of bail has been filed on behalf of the applicant by none other than the complainant herself. It appears that this is more a case of a matrimonial dispute between the applicant and the complainant rather than anything else. Even otherwise, necessary seizures have already been made and the custodial interrogation of this applicant is not required. I am, therefore, of the view that this application deserves to be granted.
ba.442.18 2/2 The application is allowed. It is directed that the applicant be released on bail on his furnishing a P.R. Bond of Rs.30,000/- together with one solvent surety in the like sum on the following conditions :
i.
The applicant shall not tamper with the prosecution witnesses in any manner.
ii. The applicant shall maintain peace and good behaviour and shall not indulge himself in any criminal activities.
iii. The applicant shall co-operate with the trial Court in expeditious disposal of the case.
The application is disposed of.
