Heard.

The applicant, apprehending arrest in connection with crime registered against him for offence punishable under Sections 65(e) and 83 of the Maharashtra Prohibition Act, has sought pre-arrest bail. The accusations against the applicant are that he is transporting liquor for sale in Chandrapur district though sale of liquor in Chandrapur district is prohibited, and liquor worth Rs.1,20,000/- is seized from the car owned by the applicant.

According to the applicant, the car was taken by his driver to take his relative to hospital and the applicant was not aware about the activities of driver. The grievance of the investigating agency is

2 aba287.17 that the applicant is not co-operating with it and has not disclosed the details of driver.

This Court has passed an order on 27th April, 2017 granting protection to the applicant. Except for the grievance that the applicant is not providing the details of driver, there is no other grievance by the investigating agency showing necessity of custodial interrogation of the applicant.

In the facts of the case, following order is passed:

In the event of arrest in connection with Crime No.508/2017 registered by the non-applicant, the applicant be released on bail on furnishing cash security of Rs.50,000/- (Rs. Fifty Thousand) and one solvent surety in the like amount.

The applicant shall attend the police station Ram Nagar, Chandrapur between 10 a.m. to 1 p.m. till the details of driver to whom the applicant had given his car, are provided to the investigating agency. The application is allowed in the above terms. JUDGE Tambaskar.
