Both these applicants are involved in crime No. 360/2018 registered against them at Police Station, Brahmapuri for the offences punishable under Sections 7, 13
(1) (d) read with Section 13 (2) of the Prevention of Corruption Act. This is a trap case. Major part of the investigation is over. Both these applicants were arrested on 11.4.2018. Both of them were in police custody for only one day and thereafter these applicants are detained under the magisterial custody remand. It is now clear that custodial interrogation of the applicants is not required. In the facts and circumstances, I am of the view that now no purpose would be served by keeping the applicants behind the bar.
Applications are allowed and it is directed that the applicants be released on bail in Crime No. 360/2018 registered with Police Station, Brahmapuri for the offences
2 ba444.18 punishable under Sections 7, 13 (1) (d) read with Section 13 (2) of the Prevention of Corruption Act on each of them furnishing PR Bond of Rs. 30,000/- together with one solvent surety in the like sum, on the following conditions: (1) Applicants shall cooperate with the investigating officer in the investigation, if any.
(2) Applicants shall regularly attend the trial Court on all dates of hearing as may be fixed by the trial Court. (3) Applicants shall cooperate with the trial Court in expeditious disposal of the trial.
(4) Applicants shall not tamper with the prosecution evidence in any manner.
Disposed of.
