DATED : 10-03-2025 The petitioner claims to be governed by the Old Pension Scheme, however, what is necessary to note is, that the petitioner was appointed on 100 % grant in aid section, w.e.f. 1.10.2006. In terms of what has been held by learned Full Bench in Deshmukh Dilipkumar Bhagwan and Ors Vs. The State of Maharashtra and ors [(2019(5) All MR 507], the matter would be covered by answer to question no. 2 which read as under:

"The employees who were appointed prior to 1.11.2005 in aided recognized primary, secondary schools as well as colleges of education which were receiving less than 100% grant-in-aid as on 1.11.2005 would be governed by the DCP scheme."

In that view of the matter, we are not inclined to interfere in the communication dated 10.4.2024. The petition is dismissed. No costs.
