The applicant, who is aged 82 years is apprehending arrest in Crime 396/2019 registered with Police Station Sakkardara, Nagpur for offence punishable under sections 409, 420, 467, 468, 471, 120-B read with section 34 of the Indian Penal Code and section 3 and 4 of the Maharashtra Protection of Interest of Depositors Act, 1999.

The allegations pertain to the alleged irregularities in the functioning of the Poonam Urban Credit Co-operative Society.

Most of the accused are released on bail.

That apart, the applicant was the then Director is similarly situated to accused who are released on bail.

Mrs. Deshpande, the learned APP fairly states that according to the Investigating Officer custody is required only to obtain handwriting specimen. 6.
Mr. Mardikar, the learned counsel for the applicant states that the applicant shall attend the Police Station on 22.12.2020 between 11:00 a.m. to 01:00 p.m. and shall give his handwriting specimen as required by the Investigating Officer.

The pre-arrest protection granted vide order dated 21.09.2020 is made absolute, subject to the only modification that till the charge-sheet is filed, the applicant shall attend the concerned police station as and when required by the Investigating Officer.
