Hearing was conducted through video conferencing and the learned counsel agreed that the audio and visual quality was proper.

Heard learned counsel Shri N.R.Tekade for the applicant and learned Additional Public Prosecutor Shri S.M.Ukey for the State.

The applicant is arrested on 2.2.2020 in connection with Crime No.28/2020 registered with Old City Police Station, Akola for offences punishable under Sections 354, 354-D, 341, and 506 of the Indian Penal Code and under Sections 7, 8, 11(4), and 12 of the Protection of Children from Sexual Offences Act, 2012.

The First Information Report is dated 2.2.2020. by victim herself. From the First Information Report, it is clear that the applicant used to submit to the victim that he .....2/-

loves her. When the victim was taken for medical examination, as per chargesheet, she refused to submit herself for medical examination.

Looking to accusations made in the First Information Report and looking to fact that the applicant who is a young person and is in jail since 2.2.2020, the applicant need not continue his jail presence. Hence, I pass following order:

ORDER

(1) The criminal application is allowed.

(2) Applicant-Milan s/o Ramdas Borade, in connection with Crime No.28/2020 registered with Old City Police Station, Akola for offences punishable under Sections 354, 354-D, 341, and 506 of the Indian Penal Code and under Sections 7, 8, 11(4), and 12 of the Protection of Children from Sexual Offences Act, 2012, be released on bail on his executing a P.R.Bond in the sum of Rs.5000/- with one solvent surety of the like amount.

(3) The applicant shall attend the police station once in a month i.e. on last Sunday of every month, till conclusion of trial.

With this, the criminal application stands disposed of accordingly.

(4) The order be communicated to the counsel .....3/-
