The appellant was on bail during the trial and nothing adverse is reported against him. There is no likelihood that the appeal would be heard in near future. In my view, the sentence imposed on the appellant is required to be suspended, however, on certain conditions.

Hence, the following order:

The appellant shall deposit Rs.2,00,000/- (Rs. Two Lakh Only) with the Registry of this Court towards security for compensation if finally it is to be paid to the widow of deceased at the time of hearing of the appeal.

2 apeal155.16 The learned advocate for the appellant, on instructions, states that the appellant would deposit Rs.1,00,000/- before his release and will deposit balance amount of Rs.1,00,000/- within six months.

On deposit of Rs.1,00,000/- with the Registry of this Court, the sentence imposed on the appellant shall stand suspended and the appellant be released on bail on same terms as before the Sessions Court.

The appellant shall file an affidavit within one week of his release on bail undertaking to deposit further amount of Rs.1,00,000/- with the Registry of this Court till 15th November, 2016.

The appellant shall deposit further amount of Rs.1,00,000/- till 15th November, 2016.

The amount deposited by the appellant shall be kept in any nationalized bank till the decision of the appeal. If the appellant fails to comply with any of the conditions of this order, this order shall stand recalled and the bail granted to the appellant shall stand cancellled.
