Mrs. Munshi, the learned Counsel for the respondent nos.1 and 2 states that the petitioner has an alternate remedy for challenging the impugned order before the Divisional Commissioner. It is stated that the petitioner has also not joined the affected person who has been transferred to the place from where the petitioner is transferred. It is stated that Smt. Mukta Atla has joined the place from where the petitioner is transferred. We uphold the preliminary objection raised on behalf of the respondent nos.1 and 2 and permit the petitioner to file appropriate proceedings before the Divisional Commission. The writ petition is disposed of. The points raised in the petition are kept open. If the application/appeal is filed by the petitioner within a period of 15 days, the Divisional Commissioner is directed to decide the same within a period of one month therefrom. Order accordingly. No costs.
