DATED : 3 - 8The petitioner is aggrieved by the refusal of respondent 2 to consider the application preferred seeking appointment on compassionate ground, in view of the death in harness of his grandmother.

We have perused the scheme of appointment on compassionate grounds.

A grandchild is not included in the class of beneficiaries or in the zone of consideration. 4.

It is well settled that appointment on compassionate grounds is an exception to the mandate of equality of opportunity and recruitment through open competition. Scheme for appointment on compassionate ground must be strictly construed. We cannot, and will

2 w.p. 5524.2021.odt not, expand the class of beneficiaries or the zone of consideration, contrary to the scheme of appointment on compassionate grounds which is implemented by the Maharashtra State Power Generation Company Limited. 5.

The petition is dismissed.
