Upon hearing the learned Counsel for the rival parties, it appears that the dispute pertains to the family members who run the education trust, wherein a few members are on one side and the other on the rival side.

There is no evidence about the alleged payment of amount made by any instrument and what is stated is that the payment was made in cash.

The applicant is the Secretary of the institution and there is reason to believe that the rival group is trying to involve him in the offence of cheating.

By putting certain conditions, I think the applicant deserves to be released on anticipatory bail. Hence, I make the following order :- Order A] Criminal Application (ABA) No.266 of 2015 is allowed.

B] In the event of arrest, the applicant shall be released on bail on furnishing a PR bond in the sum of Rs. 20,000/- with one solvent surety in the like amount.

C] The applicant shall attend the Police Station Jaripatka, Nagpur as and when required by the Investigating officer and shall cooperate with the Investigating Officer.
