DATED : APRIL 27, 2017 Shri Chakravarti, learned Counsel for applicant, seeks leave to withdraw the criminal application with liberty to approach learned Sessions Court contending that challenge is to the judgment passed by learned Assistant Sessions Judge, Nagpur in Sessions Trial No. 239/2016 and as such, appeal would lie before Sessions Court, Nagpur.

In the circumstances, leave as prayed is granted. The criminal application is allowed to be withdrawn with liberty as prayed for.
