Shri Dewani, learned counsel for the applicant points out that this Court vide order dated 29.10.2021 appointed Shri Justice R.K. Deshpande, (Former Judge) as an Arbitrator.

He has further drawn attention of this Court to the order dated 18.11.2021 recording the statement of Shri Dewani, learned counsel that in pursuance to the order dated 10.02.2021, passed by the Hon'ble Supreme Court of India, the Collector assessed the stamp duty at Rs.3,74,000/- and penalty at Rs.4,94,736/- and accordingly, this Court directed the Chief Controlling Revenue C.L.Dhakate

27.mca.406.23.odt Authority, Pune to decide the appeal within four weeks. Thereupon, the Chief Controlling Authority remanded the matter for deciding the same afresh to the Collector of Stamps who in tern vide order dated 17.08.2022 directed the applicant to deposit insufficient stamp duty and penalty on the same. It is submitted that, the said order has been complied with on 29.07.2022.

The applicant has accordingly filed a pursis dated 28.09.2022. In that view of the matter, the application is disposed of.

No order as to statement of disclosure is necessary in view of the fact that Shri Justice R.K. Deshpande, (Former Judge) has already submitted statement of disclosure along with his consent on 16.11.2021.
