Heard the learned Counsel for the rival parties.

The offence took place on 19-02-2015 and since then the applicant is in jail. Perused the first information report and the statement of Yogita. From perusal of the statement, it appears that the applicant Archana exceeded her duty towards Yogita and assaulted her by throwing burning stick on her saree. Admittedly, chargesheet has been filed. The learned Counsel for the applicant submits that the applicant has a child aged about 5 years and the applicant would stay away and not enter the village Aamsari, Tq. Khamgaon, Dist- Buldana till the trial is over. Looking to the provisions of Section 437 of the Code of Criminal Procedure and the fact that the chargesheet has been filed, I make the following order :-

Order A] Criminal Application (BA) No.371 of 2015 is allowed.

B] The applicant shall be released on bail on furnishing a PR bond in the sum of Rs. 10,000/- with one solvent surety in the like amount.

C] The applicant shall not enter the boundary of village Aamsari, Tq. Khamgaon, Dist- Buldana and shall not tamper the prosecution evidence.
