The F. I. R. has been filed about three days after the incident. The F. I. R. and the statement of father of the victim girl show that parents of the victim girl had learnt about the incident on the same day, i.e. on 12/12/2015, however, the F.I.R. has been lodged on 15/12/2015. It appears from the F.I.R. that what prompted filing of the F.I.R. against this applicant by the mother of the victim girl was experiencing pain by the victim girl while sitting and standing up and what was told to the mother by Dr. Minaxi Mane regarding commission of rape upon the victim girl.
The F.I.R. shows that the victim girl had complained of pain in private parts. The medical report, however, does not show any such circumstance as to be the cause of experiencing pain by the victim girl.
The charge sheet has been filed. From the kind of evidence that is available in this case, I do not think any purpose would be served by keeping the applicant in jail for any longer period of time. Hence, the following order.:
The application is allowed and it is directed that the applicant be released on bail on his executing a P. R. Bond in the sum of Rs.25,000/- with two solvent sureties in the like amount on the conditions that the applicant shall regularly attend the dates fixed by the Court in the case, shall cooperate with the Court in expeditious disposal of the case and shall not tamper with the prosecution witnesses.
