Heard Shri I.S. Charlewar, learned counsel for the applicant/ petitioner and Shri N.R. Patil, learned AGP for the respondents.

The only question is, whether the petitioner who was dismissed because of Anti corruption trial against him and after acquittal reinstated, is entitled to claim entire period of suspension as duty period. He has already superannuated.

It is an admitted position that there was no departmental inquiry against him.

In this situation, civil application is allowed. List Writ Petition No. 2751 of 2016 for final hearing in the week commencing from 23.07.2018.
