However, with the assistance of Shri A. V. Khare, the learned counsel for the respondent No.1, we have perused the writ petition and the documents filed along with it. According to the petitioner, due to non-availability of the learned Chairperson of the Debts Recovery Appellate Tribunal at Mumbai, the appeal filed by the petitioner could not be heard. Hence, it is prayed that till 26/06/2015 the possession of the auction property may not be taken. Shri A. V. Khare, the learned counsel for the respondent No.1, submits that the learned Chairperson is now available at the Appellate Tribunal at Mumbai and hence, the petitioner is free to prosecute his remedies before said Forum.
Considering the limited nature of relief sought and as the learned Chairperson is now available, the writ petition is disposed of with no order as to costs.
