This application is for condonation of 397 days delay caused in filing application to bring on record legal heirs - wife and son of the deceased petitioner, contending that they had no knowledge of pendency of petition, if any, filed by the petitioner wherein the deceased petitioner has claimed some

1707appw127.19 amount deposited by him while securing bail, as cash security.

Having considering the subject matter and since the delay caused is satisfactorily explained, application is disposed of as allowed.

CRIMINAL APPLICATION (APPW) NO. 128 OF 2019 Heard.

In view of the order passed above, condoning delay in bringing on record legal representatives of original petitioner, present application is allowed thereby setting aside the order of abatement, if any, passed.

The learned counsel for the petitioner shall take steps to amend the petition, bringing on record Legal representatives forthwith.
