Heard the learned Counsel for the applicant and the learned A.P.P. for the State.

This case is yet another example of how the educated unemployed youths of this country are being deceived in parting with huge sums of money on the elusive dreams of securing jobs for them. The name of the applicant is specifically appearing in the F.I.R. and the allegations are made against him that he had taken money by making false representations to them for securing jobs. The complainant is not a singular candidate, there are about 29 candidates and all of them are saying that they had paid certain sums of money, while the complaint says money was paid to this applicant, others say sums of money were paid to the other accused person, who were present at the office of this applicant. All these persons have been prima facie deceived by the applicant and his associates.

Although, the learned Counsel for the applicant submits that no receipt has been produced before the police, I am of the view that no person would issue any receipt for such a deal and then the question is why such allegations are made unless there is some truth in them and which prima facie appears to be originating from the sufferings of these gullible unemployed youth because of the actions alleged against this applicant and others. In such a case, statements of the witnesses would assume great importance, which cannot be dismissed straight away. The custodial interrogation of this applicant would, therefore, be required. The application cannot be allowed. The application stands rejected.
