Learned APP waives notice for the State/nonapplicant no. 2. Criminal Application (APPP) No. 564/2015 At the outset, learned counsel for the applicant submits that inadvertently, a prayer in nature of seeking issuance of directions that no coercive action be taken against the applicant in view of the statements made in paragraph 2 of the application remains to be added in the prayer clause. Shri Gode, learned counsel prays for amendment by adding said prayer as prayer clause (ia).

The oral request of the learned counsel for amendment in the application is granted.

The amendment be carried out forthwith.

2 appa185.15.odt Shri Gode, learned counsel by inviting my attention to the grounds referred to in paragraph nos. 1 and 2 of the present application submits that the applicant apprehends that the learned District and Sessions Judge may pass some order on the application seeking recovery of the amount and pray for grant of relief in terms of added prayer clause (ia). Shri Gode, learned counsel further submits that the applicant/appellant has raised substantial grounds in the revision/appeal.

In view of the submissions of learned counsel for the applicant, ad-interim relief in terms of added prayer clause (ia) till the non-applicant no. 1 causes appearance before this Court.
