Respondent No.l has expired. There is a delay of 43 days in filing the application for bringing his legal representatives on record. It is stated that the appellant wanted to engage another Advocate in the matter and has also approached the Legal Aid Authority for engagement of another Advocate. It is stated that thereafter the present Advocate is engaged in the matter and in such circumstances, some time was consumed in collecting the case-papers from the earlier Advocate and handing over it to the present Advocate. 03.

The delay is properly explained. Having regard to the above, the civil application is allowed. The delay caused in filing the application for bring the legal representatives of deceased-respondent No.1 is condoned, abatement of appeal against deceased-respondent No.1 is set aside and permission to bring legal representatives of deceased-respondent No.1 on record is granted. Necessary amendments be carried out on or before 30th September, 2025.
