IN THE HIGH COURT OF JUDICATURE AT BOMBAY
NAGPUR BENCH, NAGPUR WRIT PETITION NO. 3288 OF 2022 (Arvind Kumar Vs. Western Coalfields Limited, thr. General Manager, Coal Estate, Civil Lines, Nagpur & Anr.) WITH WRIT PETITION NO. 3316 OF 2022 (Narottam s/o Kumar Deepak Vs. Western Coalfields Limited, thr. General Manager, Coal Estate, Civil Lines, Nagpur & Anr.) Office Notes, Office Memoranda of Coram, appearances, Court's orders of directions Court's or Judge's order and Registrar's orders.
Ms. Sonali Saware - Gadhawe, Advocate for the petitioners. Shri O.A. Ghare, Advocate for respondent No.1. Shri V.A. Bramhe, Advocate for respondent No.2. CORAM : A. S. CHANDURKAR AND URMILA JOSHI-PHALKE , JJ.
D ATE : JULY 19 , 202 2 .
In these Writ Petitions, the petitioners had responded pursuant to the employment notification dated 11/10/2021 whereby the respondents intended to recruit 'Mining Sirdar' as well as 'Surveyor (Mining)'. The petitioners were not issued Admit Cards for the reason that they had submitted Restricted Competency Certificate. The petitioners were informed of not having been shortlisted for the written test on 10/4/2022. About 35 candidates were not shortlisted for the same reason. It is seen that the written test was held on 24/4/2022 and the results were declared on 26/5/2022. The present Writ Petitions have been filed on 13/6/2022.
We therefore find that the situation has now become irreversible in view of the fact that the examination has been conducted and results have also been declared.
In these facts, we find that as the petitioners have approached this Court late and not immediately after the intimation was given to them on 10/4/2022, we are not inclined to consider the prayers made in the Writ Petitions which pertain to a declaration that the petitioners are eligible for the aforesaid posts. Hence keeping the points raised in the Writ Petitions open, the same are disposed of.
2 88-WP-3288-2022.odt The fees of the learned Counsel appointed for the petitioners shall be paid as per Rules.
