By this petition, the petitioner claims that action needs to be taken against the respondent for alleged contempt of judgment and decree dated 09.12.2016 passed by the Court of Civil Judge Junior Division, Kalmeshwar, in Regular Civil Suit No.39/2009.

On 22.03.2022, this Court passed the following order:

"The record shows that when this petition was listed for hearing on 29.11.2021, the learned counsel appearing for the petitioner was absent.

2. This petition was adjourned for eight weeks to give one more chance to the petitioner to pursue this petition. Even today when the petition is called out for hearing, none has appeared on behalf of the petitioner.

3. Hence, list on 04.04.2022 under the caption "for dismissal".

Even today, when the petition is called out for hearing none has appeared on behalf of the petitioner. Even otherwise, a perusal of the judgment and decree dated 09.12.2016 passed by the Court of Civil Judge Junior Division, Kalmeshwar, would show that it is a decree which is executable.

In view of the above, the contempt petition is dismissed.
