Heard Mr. S. P. Mokadam, learned counsel for the petitioners and Mr. N. R. Raut holding for Mr. N. B. Kalwaghe, learned counsel for the respondents. 2.

The petitioners challenge the judgment and order dated 05.02.2019 passed in M.C.A. No.42 of 2018 by the learned Principal District Judge, Bhandara, whereby the learned Appellate Court allowed the appeal filed by the respondents - original defendants and set aside the order dated 05.09.2018 passed in Special Civil Suit No.31 of 2018 below Exhibit - 5 by the learned Joint Civil Judge Senior Division, Bhandara.

Mr. N. R. Raut holding for Mr. N. B. Kalwaghe, learned counsel for the respondents submits that in the present writ petition, there is no interim order in operation. He further submits that the suit is kept for recording the evidence of the plaintiffs.

In view of that and since the judgment and order passed by the learned Appellate Court in the year 2019, nothing survives in the present writ petition and the same is disposed of accordingly.
