Heard.

The applicant is apprehending arrest in Crime 30 of 2018 registered at the Police Station, Sonegaon for offence punishable under section 380 of the Indian Penal Code.

Case of the Investigating Agency is that cartons of cigarettes were stolen from the godown of the Customs Office at the Nagpur International Airport.

It is not even the case of the Investigating Officer that the applicant was in-charge of the godown. The learned APP Shri N.H. Joshi fairly states on instructions, that at least at this stage, there is no material to so suggest. In this view of the matter, the application is allowed. The interim order dated 23.4.2018 is confirmed subject to the modification that the applicant shall attend Police Station, Sonegaon as and when required by the Investigating Officer.
