Heard Shri Mir Nagman Ali, learned counsel for the applicant and Mrs. Prabhu, learned APP for the non-applicant, through video conferencing. The applicants are protected by this Court vide ad interim bail order dated 09.06.2020.

A perusal of the affidavit in reply filed on behalf of the non-applicant - State does not reveal any specific allegation against the present applicant, who is the cousin of main accused i.e. accused No. 7 - husband of the deceased.

In First Information Report, in all 7 accused are involved for the offence punishable under Section 498-A and 304-B read with Section 34 of the Indian Penal Code. It is stated that other co-accused, except

2107aba280.20 main accused i.e. accused No. 7, the husband, are on bail.

Considering the role attributed to the present applicant, in my opinion, custodial interrogation is not warranted. Hence, ad-interim protection granted to the applicant earlier is hereby confirmed on same terms and conditions.

Criminal Application is allowed and disposed of accordingly.
