The applicants, apprehending arrest in connection with crime registered for the offence punishable under Section 324 read with Section 34 of the Indian Penal Code, seek pre-arrest bail.
Initially, the crime was registered against the unknown persons, however, as investigation progressed, the applicants are shown as offenders. The accusations against the applicants are that they have assaulted the victim because of which he has suffered injuries. The applicant No.1, aged about 25 years, claims to be a Labourer and has stated that he is not involved in any other crime / offence. The applicant Nos.2 and 3, aged about 27 years and 30 years, claim to
2 aba291.17 be Labourer and Agriculturist respectively and have stated that except for a crime for offence punishable under Section 324 of the Indian Penal Code which was registered against them long back and in which they are acquitted, no other crime is registered against them. This Court has granted protection to the applicants by order passed on 2nd May, 2017 imposing conditions on the applicants. The investigating agency has not complained that the applicants have not co-operated with it.
Considering the facts of the case, the order passed by this Court on 2nd May, 2017 granting protection to the applicants is confirmed. The application is allowed accordingly.
