DATED : 05-06-2018 The applicant is apprehending arrest in Crime 25/2018 registered at Nagpuri Gate Police Station, Amravati for offence punishable under Section 306 read with Section 34 of the Indian Penal Code.

One Ganesh Jawanjal, a Gate-man working with the Railway committed suicide on 04-1-2018.

The applicant is the estranged husband of one Lata. The accusation against the applicant is that he suspected that Lata and the deceased were in a relationship and exploited the situation by demanding an amount of Rs.40,000/- from the deceased. The harassment led the deceased to commit suicide, is the accusation.

The learned Additional Public Prosecutor fairly states that custodial interrogation is not necessary.

In any event, considering the nature of allegations, even prima facie it is difficult to discern any material suggesting the existence of mens rea. 6.

The application is allowed. The interim order dated 25-4-2018 is confirmed JUDGE adgokar
