The communication dated 22.11.2024, which is under challenge in this petition, was issued in response to the petitioner's request for pensionary benefits. In the said communication, it was stated that, in the service book of the petitioner's deceased husband, Namdeo Domaji Gadpal, the name of the wife recorded therein is Sau. Kusum Namdeo Gadpal, who according to the petitioner is the second wife of Namdeo.

It is the case of the petitioner that she is the first wife of Namdeo and is entitled for the pensionary benefits on death of her husband.

It is further submitted that even Sau. Kusum has expired and the respondents cannot deny the pensionary benefits to the petitioner.

Considering the nature of the communication and nd.thawre
2/2 the claim of the petitioner, we request the respondent No.6-The Principal District and Sessions Judge, Amravati shall take into consideration the documents available with the service book of the husband of the petitioner and the grounds raised in this petition as well as the documents annexed thereto, and decide the claim of the petitioner for pensionary benefits in accordance with law.

Such exercise shall be completed by the respondent No.6 within four months from the date of furnishing the copy of the present petition and the documents annexed thereto along with a copy of this order.

The learned counsel for the petitioner undertakes to furnish a copy of the present petition and the documents annexed thereto along with a copy of this order before the concerned authority within a period of one week from today.

The respondent No.6 if deems it appropriate, shall grant hearing to the petitioner before deciding the claim. 9.
Accordingly, the petition is disposed of in the above terms.
