Heard learned Advocate Shri Dhoble for the applicant. As per his submission, the applicant is arrested only on suspicion. The applicant has not committed any offence. Nothing is recovered from the applicant. The applicant is entitled for bail.

Heard Shri Rode, learned Additional Public Prosecutor. He has submitted that the applicant is a criminal. He along with other accused were going to commit dacoity and, therefore, arrested.

From the perusal of report, it appears that accused were going on motorcycle. They were possessing pliers and other articles. The applicant has not committed any offence. Only allegation is that they were about to commit offence. Looking to the allegations in the report, the applicant is entitled for bail. Hence, the following

(I) The application is allowed.
(II) The applicant be released on bail on executing PR Bond in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand only) with one solvent surety of like amount on following conditions.
(a) The applicant shall not tamper the evidence of prosecution witnesses.
(b) The applicant shall attend the trial Court on each and every date.
(c) The applicant shall not commit any crime/offence. (d) Breach of any condition amounts to cancellation of bail.

The application is disposed of.
