DATED : 21/08/2021 In anticipation of arrest in Crime No.246 of 2021 registered at Police Station Telhara, District Akola for the offences punishable under Sections 420, 465, 468, 471, 120-B read with 34 of the Indian Penal Code, the applicant is seeking for pre-arrest bail. 2.

The non-applicant/State resisted bail by filing affidavit-in-reply.

With the assistance of both the sides, perused First Information Report lodged by one Khushal Kharapkar. It is over all contention that the applicant and one co-accused namely Manik Gawarguru have assured to manage an employment to the applicant in Railway Department on payment of Rs.18 lakhs. The entire story narrated in First Information Report discloses that, time to time the applicant met informant's father, kept on giving assurances and

2 16 aba 457.2021.2021 Rs.18 lakhs, were extracted from the informant' s father. The First Information Report discloses that in order to gain faith, some time the informant was taken to some Railway's offices at Delhi and at some training center. Entire reading of First Information Report discloses that the applicant took leading part and taken hard earned money of Rs.18 lakhs from the informant on false assurances.

The Police paper discloses that the applicant in connivance with some more person, was indulging into such business of deceiving innocent. It reveals that informant's father has sold his agricultural land, valuables for getting job to his son, but in vain. The investigation is required on various angles to find out the applicant's contacts at various places. It is to be investigated as to where the informant was taken and made to undergo training. Prima facie, it appears that several other persons from other State are also part of the racket. Moreover, money is yet to be recovered. Therefore, this is not a fit case to exercise judicial discretion to grant pre-arrest protection, hence, the application stands rejected.
