The applicant seeks pre-arrest bail apprehending arrest in connection with crime registered against him by the non-applicant for the offences punishable under Sections 376(D), 201 and 506 read with Section 34 of the Indian Penal Code.

The application is opposed by the non-applicant/ Investigating Agency. The complainant (victim) is aged about 41 years, The date of alleged incident is 13th March, 2018. The non-applicant has not been able to point out the necessity of custodial interrogation of the applicant. The applicant claims to be an agriculturist. It is not disputed that the applicant had been Sarpanch of the village.

Considering the facts of the case, following order is passed :

2 aba294.18 In the event of arrest in connection with Crime No.71 of 2018, registered by the non-applicant, the applicant be released on bail on furnishing P.R. bond for Rs.Twenty Thousand with one solvent surety in the like amount. The application is allowed accordingly.
