The applicant was on bail during the trial and nothing adverse is reported against him. There is no likelihood that the application would be heard in near future. In my view, the sentence imposed on the applicant is required to be suspended, however, on certain conditions.

Hence, the following order:

The applicant shall deposit Rs.1,00,000/- (Rs. One Lakh Only) with the Registry of this Court towards security for compensation if finally it is to be paid to the parents of deceased at the time of hearing of the application.

2 revn76.16 The learned advocate for the applicant, on instructions, states that the applicant would deposit Rs.50,000/- before his release and will deposit balance amount of Rs.50,000/- within six months.

On deposit of Rs.50,000/- with the Registry of this Court, the sentence imposed on the applicant shall stand suspended and the applicant be released on bail on same terms as before the trial Court.

The applicant shall file an affidavit within one week of his release on bail undertaking to deposit further amount of Rs.50,000/- with the Registry of this Court till 15th November, 2016. The applicant shall deposit further amount of Rs.50,000/- till 15th November, 2016.

The amount deposited by the applicant shall be kept in any nationalized bank till the decision of the application. If the applicant fails to comply with any of the conditions of this order, this order shall stand recalled and the bail granted to the applicant shall stand cancellled.
