After arguing the writ petition for some time, the learned counsel for the petitioner, on instructions, submits that the petitioner would report at Dakshin Karnataka on 9-5-2023 where she has been posted for election duty. He submits that till that period, the petitioner would apply for leave by moving an application before the respondent No.2.

In view of aforesaid, by accepting the statement made by the learned counsel for the petitioner, the petitioner is permitted to apply for leave by moving an appropriate application before the respondent No.2. In the facts of the case, the respondent No.2 shall consider the said application and pass appropriate orders in the light of the fact that the petitioner has a 24 months' old child. Since the petitioner has stated that she would join the duty on 9-5-2023, the communication dated 1-5-2023 shall not be acted upon till that date. 3.
