Heard.

The applicant is seeking regular bail in Crime 349 of 2017 registered at the Sakkardara Police Station, Nagpur for offence punishable under section 395, 397 of the Indian Penal Code read with sections 3/25 and 4/25 of the Arms Act and section 135 of the Maharashtra Police Act. The bail is claimed on the ground of parity.

The applicant is the only accused in custody. The remaining five accused are released on regular bail. The learned counsel for the applicant has placed on record copies of the orders by which three accused were granted bail. Prima facie, it does appear that the material and the accusations against the present applicant are similar

ba452of18.odt 2 to those against accused Rajesh Jat and Suraj Tiwari. The State has not challenged orders granting bail to the other accused.

The accused is in custody since 21.11.2017. Since bail is granted to the other accused who are similar situate, I am inclined to allow the application. The applicant be released on furnishing personal bond of Rs. 15,000/- with a solvent surety of like amount. The applicant shall attend Police Station, Sakkardara, Nagpur once in a month between 10.00 a.m. to 12.00 p.m.

The applicant shall not tamper with the evidence nor shall applicant directly or indirectly attempt to influence the witnesses in any manner.
