The prayer made in the application is for release of demand draft in favour of the respondents-bank. The Bank is the applicant in the present application.

Since it is borne out of the record that the validity of the demand draft has already expired and the parties have arrived at an amicable settlement, only the balance amount which is to be paid by the petitioners is the one reflected in the demand draft.

The counsel for the petitioners, on instructions, submits that in case if the demand draft is permitted to be collected, the same would be submitted to the Bank after its revalidation within a period of one week from the date on which it was collected. Since the statement is made on instructions, same is accepted as an undertaking to this Court.

To the aforesaid submission, the counsel for the respondent nos.1 and 2 to the petition, who are applicants in the application, has consented for the same.

That being so, the application stands disposed of in the following terms:
