By this application, the applicant is seeking relaxation of condition imposed by this Court while releasing the applicant on bail.

The applicant is arraigned as an accused in connection with Crime No.399/2024 registered with Police Station Civil Lines, Akola for the offences punishable under Sections 64, 64(2)(m), 137(2) of the Bhartiya Nyaya Sanhita, 2023 and under Section 3 and 4 of the Protection of Children from Sexual Offences Act, 2012 while releasing the applicant on bail the condition imposed was that the applicant shall not induce, threat or promise, or in any witnesses and he shall not enter into the Akola City as well as Akot, wherein the victim is residing, till culmination of

Now the application is filed on the ground that the marriage of the his real brother of the present applicant is scheduled on 30.04.2025 and being he is the real brother of the applicant has to attend the marriage ceremony as well as the ceremony prior to the marriage and after the marriage and therefore, he be permitted to enter into the vicinity of Akot from 29.04.2025 to 01.05.2025.

Learned APP strongly opposed for the same.

Heard learned counsel considering the reasons mentioned in the application supported by the wedding card. The applicant is permitted to enter into the Akola City as well as Akot, wherein the victim is residing for the period i.e. 29.04.2025 to 01.05.2025.

The application is partly allowed.
