Though, non applicant no.3 is served and in spite of chances given on 18.09.2018, nobody appears for the said non applicant. Consequently, the present application for condonation of delay, which is on affidavit, is hereby allowed.

Delay in filing the appeal is condoned. Office is directed to register the appeal.

caf1676.18.odt Civil Application No. 1677/2018 This is an application for staying the effect and operation of the judgment and award dated 10.03.2017 passed by learned Civil Judge Senior Division, Gondia in Land Acquisition Case No.08/2013. This Court granted ad interim stay on 22.06.2018 on a condition that the appellant shall deposit entire decreetal amount. In pursuant to the order passed on 16.08.2018, the appellant has deposited an amount of Rs.22,10,500/- before this Court.

In that view of the matter, the application is allowed and disposed of. Ad interim order granted on 22.06.2018 is hereby confirmed.
