DATED : MAY 26,2020 Hearing was conducted through video conferencing and the learned counsel agreed that the audio and visual quality was proper.

Heard learned counsel for the applicant. The applicant is an accused along with two other persons as per FIR dated 24.04.2020 registered for offence punishable under Sections 304, 201 read with Section 34 of the Indian Penal Code.

The husband of the complainant has died and it is alleged by the complainant that the applicant herein was party to destruction of evidence. Insofar as the incident was concerned, it is pointed out by learned counsel appearing for the applicant that complainant was no eye witness to the incident and that FIR itself was lodged after about 12 days of
the incident.

It appears that even as per complaint the main allegations are against accused Deepak Shrinath and that the allegation against the applicant, at worst, is of assisting the aforesaid main accused in covering up the manner in which the incident took place.

Considering the aforesaid material, a case for ad interim protection is made out. Hence, issue notice returnable in the week commencing 15.06.2020. 6.
Mr. Damle, learned APP waives notice on behalf of the non-applicant State.

In the meanwhile, in the event the applicant is arrested in connection with FIR No.116/2020 registered with Police Station Channi, District Akola, he shall be released on ad interim anticipatory bail on furnishing PR bond of 25,000/-.

Applicant shall make himself available before the investigating officer as and when required. He shall cooperate with the investigation.

Learned counsel for applicant is directed to supply hard copy of the application along with documents to the learned Additional Public Prosecutor.
